Under drunk driving law in New Jersey, someone charged with drunk driving can be prosecuted as a traditional DWI, in which the prosecution attempts to prove a person was under the influence based on driving patterns and a field sobriety test performance, or by a showing of violation of the per se law which has a legal limit of .08 percent.
